Abstract
Das Leitbild des Föderalismus war von Anfang an Teil der Debatte zur europäischen Integration. Die gegenwärtige EU weist Merkmale eines föderalen Systems auf, ohne dabei den Strukturen eines bestehenden Föderalstaats zu entsprechen. Im Laufe des Integrationsprozesses ist vielmehr ein Föderalismus „sui generis” entstanden, der sich im Rahmen der Konstitutionalisierung der EU, vor allem auch durch die Vorschläge des Verfassungskonvents, weiterentwickelt. Der Beitrag versucht solche Verfassungsbestimmungen zu identifizieren, die den Charakter der künftigen EU als Föderation verstärken; er zeigt, dass diese weiterhin nicht auf einen bestimmten Typus eines föderalen Systems hinführen („dualer Föderalismus”, „kooperativer Föderalismus” oder „Politikverflechtung”).
Abstract
From the outset, the idea of federalism has been part of the debate on European integration. The present EU can be regarded as deploying features typical of a federal system without resembling any particular pattern of existing federative states; rather, it has emerged as a special type of federal structure (“sui generis”), and the Convention has contributed to this constitutional development even further. This article tries to identify provisions in the Constitutional Treaty that contribute to the character of the future EU as a federation. These provisions, however, do not really point to one particular type of federal system (“dual”, “cooperative” or even “interlocking” federalism).
