Zusammenfassung
Der Aufsatz verfolgt die These, dass sich in normativen Ordnungen jenseits des Nationalstaats Tendenzen der Konstitutionalisierung identifizieren lassen. Sie verlaufen in zwei unterschiedlichen Richtungen. Verfassungen bilden sich außerhalb der Grenzen des Nationalstaats in transnationalen Politikprozessen und zugleich außerhalb der transnationalen Politik in den „privaten“ Sektoren der Weltgesellschaft. Die Transnationalisierung stellt der Verfassungssoziologie die dreifache Aufgabe: (1) real ablaufende Konstitutionalisierungsprozesse außerhalb der Nationalstaaten empirisch zu untersuchen, (2) eine Theorie des transnationalen gesellschaftlichen Konstitutionalismus zu entwerfen und (3) soziologische Problemvorgaben für normative Perspektiven in Politik und Recht zu entwickeln.
Summary
The article submits the following thesis: trends of constitutionalization can be identified in normative orders beyond the nation state. They follow two different directions. Outside the limits of the nation state constitutions emerge in transational politics and they emerge simultaneously outside the limits of transnational politics in the “private” sectors of global society. Transnationalization confronts constitutional sociology with three different challenges: (1) to analyze empirically ongoing constitutionalization processes beyond the nation state, (2) to design a theory of transnational societal constitutionalism, and (3) to develop sociological preconditions for normative perspectives in politics and law.
