Abstract
The article deals with the subject »stealthing« and is summing up currently prevailing opinion, judicial rulings made so far as well as scientific perceptions. Starting with a general introduction of stealthing it continues to present judicial rulings made recently in Germany and in Switzerland. First basic research studies on stealthing are outlined, followed by a legal assessment focussing on indictability as well as on unlawful action in regard to stealthing. At the end of the article the author expresses his opinion on the subject, draws a conclusion and proposes for further scientific discussions respectively considerations about an expansion of § 177 StGB.
