Zusammenfassung
Die Rechtskultur der Vereinigten Staaten von Amerika - und vermutlich die anderer Länder in ähnlicher Weise – hat sich seit Beginn des 19. Jahrhunderts grundlegend verändert. Hiervon sind sowohl das Zivil- als auch das öffentliche Recht betroffen. Ein neues Rechtsprinzip hat sich entwickelt, das ich eine „generalisierte Gerechtigkeitserwartung“ nenne; diese ist an die Stelle eines niedrigen, eher skeptischen Erwartungspegels an das Rechtssystem getreten. Der Beitrag versucht einige Gründe für diese Erwartungsveränderungen anzugeben, so die Verminderung von Lebensunsicherheiten durch Technologie und soziale Erfindungen, und die Auswirkungen der neuen Rechtskultur auf das materielle ebenso wie auf das Verfahrensrecht im Zeitalter des Wohlfahrtsstaates.
Summary
The legal culture of the United States - and by implication other countries as well – has undergone massive change in the period since the beginning of the 19th century. Change has affected both private and public law. A new popular principle has developed, which I call the “general expectation of justice”; it replaces a culture of low expectations with regard to the legal system. The paper attempts to describe the causes which led to this transformation – including the reduction of life-uncertainties through technology and social invention – and the impact of the new legal culture on substantive and procedural law in the era of the welfare state.
