Zusammenfassung

Verfahrensvorschriften in Form formalisierter juristischer Sprechhandlungen sollen die normative Konsistenz der Rechtsanwendung sichern. Gegenstand der Untersuchung ist die individuell praktische Umsetzung einer Verfahrensvorschrift am Beispiel der richterlichen Zeugenbelehrung in einem Zivilprozeß. Mit ihrer Anwendung erfährt die Rechtsregel eine Transformation, die hier mit der Methode der objektiven Hermeneutik auf die ihr inhärenten Sinnstrukturen rekonstruiert wird.

Summary

Procedural rules which occur through formalized juridical speech acts are determined to secure the normative consistency of the employment of legal rules. The article investigates the application of a legal rule as it is handled in practice, taking the witness instruction by judge as an example. The result is that the legal-procedural rule when applied experiences a transformation, the inherent meaning of which is reconstructed by using the method of objective hermeneutics.
