Zusammenfassung
Recht kann nur unter der Voraussetzung produziert werden, daß sich Einrichtungen ausdifferenzieren, welche die materiellen und symbolischen Bedingungen der zur Rechtsproduktion erforderlichen Kommunikation sichern (Rechtskultur). Ein möglicher Weg der empirischen Erfassung von Ausbau und Funktionsweise dieser Einrichtungen wird hier am Beispiel Portugal vorgestellt. Auf diese Weise gesammelte Daten können zur Behandlung verschiedener rechtssoziologischen Fragen beitragen, von der klassischen Frage der Effektivität bis zur Problematik der Abhängigkeitsbeziehungen zwischen Rechtssystemen.
Summary
Law can only be produced if institutions have been consolidated, which provide the material and symbolic conditions of the communication required for the legal production (legal culture). In this paper – based upon the case of Portugal – I will set out a possible way to analyse empirically the development and the functioning of these institutions. By this way, various data may be collected for the treatment of different important questions the sociology of law is dealing with, such as the classical problem of the effectivity of law, or the problem of the dependence links between legal systems.
