Zusammenfassung
In einem Diskurs von objektiver Formbestimmung und kultureller Existenz wird eine strikt existentielle Sichtweise auf das Recht entwickelt. Über eine solche Wendung ins Existentielle werden Geltung, Funktion, Struktur und Wirksamkeit von Recht thematisiert, um auf diesem Wege eine Annäherung an einen rechtssoziologisch orientierten Rechtsbegriff zu erreichen.
Summary
A strictly existential approach to law is developed through a treatment of objective determination and human self-determination. In order to get closer to a sociological concept of law, the validity, function, structure and effectiveness of law are discussed in the framework of this existential approach.
