Zusammenfassung
Für die ökonomische Analyse des Rechts ist es von historischem und systematischem Gewicht, daß Soziologie als eine Kritik des ökonomischen Paradigmas entstanden ist. Wenn die ökonomische Analyse des Rechts also weder hinter den erreichten Entwicklungsstand der Gesellschaftstheorie zurückfallen will noch aber die subtilen Überlegungen einer fortgeschrittenen ökonomischen Theorie ausgeblendet werden sollen, müßten zumindest auch die jeweiligen ökonomischen, soziologischen und juristischen Konstruktionen sozialer Wirklichkeiten reflektiert und aufeinander bezogen werden.
Summary
The study deals with the historical and systematic problem of any economic analysis of law that sociology emerges as a critique of the economic paradigm. If economic analysis of law will therefore neither fall behind the hitherto attained level of discussion nor ignore the explanatory power of sophisticated economic analysis it has to be understood as an interdisciplinary task, starting with a reflection of its respective procedures of constructing their field of research.
