Zusammenfassung
Die Ausdifferenzierung moderner Gesellschaften hat einen Stand erreicht, bei dem das Mediensystem mittlerweile eine prominente Rolle spielt: Es konstruiert die. "reale" Wirklichkeit nicht mehr - mehr oder minder adäquat - einfach nach, sondern es generiert im Prozeß dieser laufenden Nachkonstruktion mittlerweile eine Medienrealität, die eigenständig operiert und ihrerseits die „reale“ Wirklichkeit überstrukturiert Relevant ist daher nicht mehr das, was „wirklich“ relevant ist, sondern das, was in den Medien als relevant aufscheint. Auf diese Entwicklung muß sich auch das Rechtssystem einstellen.
Summary
The differentiation of modern societies provides a key role for the subsystem of communication: media meanwhile don’t simply molder - more or less precisely - the „real“ reality; instead of, the construct a media reality of its own, which may override the „real“ reality. According to this development, important is not what is „really“ important but what the media say that is important. Other subsystems of society have to take into account these two realities and, furthermore, that the construction of media reality follows the specific rules of the communication system itself.
