Zusammenfassung
Menschenrechte tragen in zweifacher Hinsicht zur Evolution der Weltgesellschaft bei. Zum einen entkoppelt das Menschenrechtsregime politische und rechtliche Inklusion von ihrer strikten territorialen Eingrenzung, zum anderen bringt es als deutungsoffenes Symbol die Ordnung der Weltgesellschaft symbolisch zum Ausdruck. Diese symbolische Dimension des Menschenrechtsregimes steht im Mittelpunkt des Artikels, der im Anschluss an Institutionen- und diskurstheoretische Arbeiten sowie an die Debatte um weltgesellschaftliche Entgrenzungsprozesse die Bedeutung der Menschenrechte vor diesem Hintergrund rekonstruiert und empirisch illustriert.
Summary
Human Rights are playing two different roles in the evolution of the world society. On one hand the human right regime separates political and legally inclusion from their territorial bordering. On the other hand as an empty signifier it expresses the order of world society. This symbolic dimension is the main topic of the article. Following institutional analyses and different works of discourse theory the function of human rights for debordering processes in world society will be reconstructed and empirically illustrated.
