Recht und soziale Bewegung: Wege zu einem neuen Dialog

Law and collective action: Avenues towards a new dialogue

Zusammenfassung

Lange war die soziale Bewegungsforschung von einer Abwesenheit des Rechts als Phänomen, und umgekehrt, die Rechtssoziologie durch eine Abwesenheit der Forschung über soziale Bewegungen gekennzeichnet. Dieser doppelten Forschungslücke hat man sich in den letzten Jahren angenähert. Forschungen haben sich etwa mit der gesellschaftlichen Bezugnahme auf und der „Verwendung“ des Rechts beschäftigt, mit dessen politischer Mobilisierung, mit dem Engagement von JuristInnen in sozialen Bewegungen, aber auch mit Rechtsentwicklungen, wie sie als Ergebnis von Kämpfen sozialer Bewegungen zustande kommen. Im Beitrag wird eine Synthese dieser verschiedenen Forschungsrichtung zum Thema Recht und kollektive Aktion vorgenommen, um von hier aus neue Wege für weitere Forschungen zu diskutieren.

Abstract

For many years social movement research was characterized by an absence of law as a phenomenon, and vice versa, sociology of law was characterized by an absence of research on social movements. More recently, steps have been taken to approach this dual research gap. Research has addressed, for example, the social reference to and ‘use’ of law, its political mobilization, the involvement of lawyers in social movements, and also legal developments that emerge from struggles by social movements. The article presents a synthesis of these different studies on the issue of law and collective action to provide the starting point for a discussion of new ways to take research forward from here.
