Abstract

In our article, we engage with the anthropologist Gerd Spittler’s pathbreaking article “Dispute settlement in the shadow of Leviathan” (1980) in which he strives to integrate the existence of state courts (the eponymous Leviathan’s shadow) in (post-)colonial Africa into the analysis on non-state court legal practices. According to Spittler, it is because of undesirable characteristics inherent in state courts that the disputing parties tended to rather involve mediators than pursue a state court judgment. The less people liked state courts, the more likely they were to (re-)turn to dispute settlement procedures. Now how has this situation changed in the last four decades since its publication date? We relate his findings to contemporary debates in legal anthropology that investigate the relationship between disputing, law and the state. We also show through our own work in Africa and Asia, particularly in Southern Ethiopia and Kyrgyzstan, in what ways Spittler’s by now classical contribution to the field of legal anthropology in 1980 can be made fruitful for a contemporary anthropology of the state at a time when not only (legal) anthropology has changed, but especially the way states deal with putatively “customary” forms of dispute settlement.

Abstract

Zusammenfassung Rechtsmobilisierung ist ein Versuch, unvermeidlich auftretende Konflikte in Gesellschaften friedlich zu bearbeiten. Sie kann daher zur Festigung von Demokratie und Rechtsstaatlichkeit beitragen. Um mögliche Wirkungen zu analysieren, muss Rechtsmobilisierung in einen sozialen und politischen Kontext gestellt werden. Ausgehend von Erhard Blankenburgs Arbeit zu individueller Rechtsmobilisierung schlägt dieser Beitrag eine Systematisierung von Rechtsmobilisierung vor, die individuelle und kollektive, diskursive und juristische Formen des Handelns umfasst. Diese Perspektive ermöglicht die Analyse der Wechselwirkungen zwischen diesen Formen. Besonders der Einbezug diskursiver Mobilisierung hilft, juristische Mobilisierung zu verstehen und zu erklären.

The Legal Interpellation of Citizens – A Constitutional Analysis

Abstract

The aim of this article is to reconstruct the legal creation of citizen subjects by applying the interpellation theory of Louis Althusser in constitutional citizenship regulations. In addition, this article uncovers the patterns of constitutionally defined rights and duties as implications of intra-constitutional subject construction, especially in relation to a political, a civil and a social dimension. For this purpose, 41 constitutions are analysed quantitatively-descriptively based on an international comparative qualitative document analysis. The study shows that constitutions, as the most fundamental legal documents at the national level, define different formal-legal qualities of citizen subjects and thus determine very specific relations between the state and its citizens. The legal citizenship regulations in national constitutions thus contribute to the stabilization of social (b)order-drawing processes to the extent that they create and secure both barriers and opportunities for individual and collective participation in society, addressing these primarily through a political and less through a civil or social legal dimension.

Abstract

Zusammenfassung Das Verhältnis der Erwartungsbildung in Staaten durch positives Recht und der Ausbildung von Erwartungen in Organisationen durch Formalisierung ist bisher theoretisch unzureichend beleuchtet worden. Aus einer systemtheoretischen Perspektive werden in diesem Artikel die Gemeinsamkeiten und Unterschiede dieser „Rechtsbildung“ auf der Ebene des Staates und der Organisation näher untersucht. Anschließend an die Diskussion über die Frage der Verantwortung für Gesetzesverstöße aus Organisationen heraus, werden die unterschiedlichen Adressierungsversuche soziologisch eingeordnet. Dabei wird gerade im Gegensatz zur in der Literatur dominanten Annahme über Regeltreue in Organisationen argumentiert, dass es aufgrund der Verrechtlichung der modernen Gesellschaft nicht möglich ist, eine klare Trennung zwischen Verstößen gegen positivierte staatliche Gesetze und formalisierte organisationale Regeln vorzunehmen.

Zwischen Absicherung, Irrelevanz und Infragestellung der Liebe: Deutungen heiratender Paare in der Thematisierung und Aushandlung von Eheverträgen

Abstract

Zusammenfassung Emotionalisierung und Rationalisierung sind elementare Prozesse westlich-moderner Gesellschaften. Eindrücklich lässt sich dies anhand von Paarbeziehungen nachzeichnen, deren Transformation im Übergang in die Moderne zugleich von der Autonomisierung der emotionalen Bindungen und der Verrechtlichung dieser Bindungen gekennzeichnet ist. Die den Paarbeziehungen zugrundeliegende emotionalen Bindungen folgen einer anderen Logik als die Formalisierung des Rechts und zugleich unterliegt jede intime Beziehung rechtlichen Rahmenbedingungen. Die individuelle emotionale Vergemeinschaftung über Höchstrelevanz und Nicht-Austauschbarkeit steht der Sachlichkeit, Vertragsförmigkeit und Austauschbarkeit des Rechts gegenüber. Die Individualisierung und Deinstitutionalisierung intimer Beziehungen haben die rechtliche Normierung des Intimen nicht aufgelöst. Rechtliche Regulierungen üben nicht nur Zwang aus, sondern geben auch die Möglichkeit, intime Beziehung zu gestalten. Es obliegt den Individuen in Paarbeziehungen dieses Spannungsverhältnis von zugleich emotionaler und rechtlicher Handlungsaufforderung auszuhandeln. Die Aneignung von Recht und das Bewusstsein für dessen Effekte auf die eigene Paarrealität setzen konkretes Wissen oder Annahmen über rechtliche Regularien voraus. Im Artikel wird auf Basis der Analyse von Paarinterviews der Thematisierung von Eheverträgen durch kurz vor ihrer Eheschließung stehender Paare und der Frage nachgegangen, wie Paare die Ambiguität von emotionaler Bindung und Verrechtlichung der Beziehung verhandeln. Eheverträge stellen eine Möglichkeit dar, zwischen der bestehenden Rechtslage und der Paarrealität zu vermitteln. Anhand empirischer Beispiele werden vier zentrale Deutungsmuster von Eheverträgen beschrieben.

About the Journal

Established in 1980, the Zeitschrift für Rechtssoziologie – The German Journal of Law and Society offers a forum for the academic analysis of law in its societal context and on the relationship between law and society. The notion of ‘society’ is interpreted broadly. The journal publishes contributions from all disciplines as long as the relationship between law and society can be identified as a core theme. Papers with a theoretical focus and empirically-based analyses are equally welcome. We also publish essays that do not follow the typical format of a journal article as long as the arguments and reasoning are of an academic standard. The journal also features a book review section which discusses recent sociology of law texts published in Germany and other countries. Submissions may be written in German or English.

Only original contributions will be published. However, contributions to the journal may be republished elsewhere provided that the place of first publication is cited.
